Incourta — Disclaimer & General Terms of Use

Incourta is operated by a company based in Indonesia, with its servers located in Indonesia. We provide digital tools for sports activities, match management, statistics, and community interaction.

By accessing or using Incourta after being presented with these terms and given an opportunity to review them, you agree to these General Terms of Use and the applicable Community Guidelines, and acknowledge the disclosures in our Privacy Policy. If you do not agree, you must not use the platform. Where separate consent or express acceptance is legally required, we will request it separately.

1. Privacy and use of data

We do not sell your personal data. We process information needed to provide, secure, and improve Incourta, including information about your activity and interactions on the platform.

We may combine this information to analyze usage patterns and produce aggregate statistics. Aggregation does not automatically make information anonymous; identifiable information remains protected under applicable data protection requirements.

Personal data may be handled by service providers supporting our operations, as explained in our Privacy Policy. That policy describes our collection, use, sharing, retention, and protection of information, along with your rights. Acceptance of these terms does not replace any separate consent required by law.

2. Legal requests and required disclosure

Incourta may be required to preserve or disclose information, including account details, user content, and activity records, to comply with applicable law, binding court orders, or lawful requests from authorized law enforcement or regulatory authorities.

We will assess the requesting authority and legal basis and limit disclosure to the information required or otherwise lawfully justified for the relevant purpose. A request does not automatically entitle the requester to unrestricted access to user information.

Where legally necessary, relevant records may be retained despite an account closure or deletion request. User notification may be restricted or delayed by law; we will provide notification where legally required. These obligations do not change our commitment not to sell personal data.

3. User content and permissions

Users are responsible for the content and information they submit. User posts, comments, reviews, and other contributions do not necessarily reflect Incourta’s views or endorsement.

You retain ownership of your content. By submitting it, you grant Incourta a non-exclusive, royalty-free permission to host, store, reproduce, technically format, and display it as necessary to provide the service, consistent with your settings and our Privacy Policy. This does not transfer ownership or authorize unrelated advertising uses.

You must have the rights and permissions needed to share content, including images and information about other people. Removal and any necessary continued retention are subject to our Privacy Policy and applicable law.

4. Accuracy of records and statistics

Some features, match records, rankings, and statistics depend on the accuracy, completeness, and timeliness of information provided by users, organizers, referees, and other contributors. Missing, delayed, or incorrect inputs may affect the information displayed.

We do not guarantee that every record is complete, current, or independently verified. Rankings, badges, and other indicators reflect available data and the platform’s methodology; they are not official certifications unless expressly stated. Records may be corrected when errors or manipulation are identified.

5. Acceptable use and fair play

You must use Incourta lawfully and respectfully. Prohibited conduct includes:

  • Harassment, threats, discrimination, exploitation, or unlawful content.
  • Fraud, impersonation, misleading submissions, or manipulation of results, rankings, rewards, or reviews.
  • Unauthorized sharing of another person’s private information.
  • Infringement of intellectual property or other legal rights.
  • Spam, malicious software, unauthorized access, or interference with platform security.
  • Unauthorized scraping, bulk data extraction, or automation that bypasses access controls or disrupts the service.
  • Circumvention of account restrictions, payment requirements, or usage limits.

6. Moderation, suspension, and termination

We may investigate suspected violations, remove or restrict content, correct manipulated records, or suspend or terminate access where reasonably necessary to protect users, enforce these terms, or meet legal obligations.

Serious violations, urgent security risks, or legal requirements may require immediate action. Where appropriate and legally permitted, we will explain the action and provide a way to request a review through Contact us. Restrictions do not automatically remove any refund or other rights you have under applicable law.

7. Access rights and intellectual property

Incourta grants you a limited, non-exclusive, non-transferable right to use the platform within your applicable service plan and these terms. Purchasing access or a subscription does not transfer ownership of our software, designs, branding, or other intellectual property.

Unless authorized by us or permitted by law, you may not copy, resell, sublicense, reverse engineer, or commercially exploit the platform or present it as your own service. This does not restrict your ownership of your content or lawful use of authorized exports.

8. Fees, subscriptions, and cancellations

Where paid services are offered, prices, billing periods, usage limits, renewal arrangements, and cancellation conditions will be disclosed before purchase. Recurring charges require the applicable authorization.

Refund eligibility follows the terms disclosed at purchase and applicable law. Changes to pricing or paid services will be communicated with any legally required notice, consent, cancellation options, or remedies.

For services sold by an independent provider, that provider’s disclosed terms also apply. Incourta remains responsible for its own obligations in the transaction.

9. Organizers, venues, and third parties

Unless Incourta expressly undertakes the role, providing platform tools does not make Incourta the organizer, referee, venue operator, or supplier of an activity.

Independent providers are responsible for their own event arrangements, permissions, facilities, safety measures, and commitments. A listing, link, or integration does not by itself constitute an endorsement or guarantee. Third-party services may have separate terms and privacy practices.

10. Physical activities and personal safety

Sports and physical activities involve inherent risks. Participants should assess their fitness, use appropriate equipment, and follow applicable safety requirements and organizer instructions.

Incourta’s statistics, recommendations, and other information do not replace professional medical advice or an appropriate safety assessment. Nothing in these terms waives responsibility for injury or other harm where that responsibility cannot legally be excluded.

11. Availability, changes, and data storage

We take reasonable steps to maintain the platform, but cannot guarantee uninterrupted or error-free operation. Maintenance, technical failures, third-party outages, and events outside our reasonable control may affect access.

We may update features and functionality. Material changes affecting paid services will be handled in accordance with our commitments and applicable law.

Incourta is not intended to be your sole archive. Keep independent copies of important information where export or download is available. This does not reduce our obligations concerning data protection, security, or agreed retention.

12. Security incidents and limitations of liability

We take reasonable technical and organizational measures to protect the platform and personal data. However, no internet-based service can guarantee absolute protection against hacking, unauthorized access, malware, data leaks, or other security incidents, including incidents involving third-party service providers.

The occurrence of a security incident does not, by itself, establish that Incourta is legally responsible or that financial compensation is payable. Responsibility and any compensation will be determined under applicable law, taking account of the circumstances and Incourta’s legal obligations. A cyberattack or third-party incident does not automatically excuse a failure to meet those obligations.

To the extent permitted by applicable law, Incourta excludes liability for indirect or consequential losses, including lost profits or business opportunities, arising from use of the platform or a security incident.

These limitations do not exclude liability arising from our negligence, fraud, intentional misconduct, breach of mandatory data protection duties, or any responsibility that cannot legally be excluded or limited. They do not restrict mandatory rights to compensation or remedies.

If a personal data breach occurs, we will take appropriate action and provide notifications as required by applicable law. Incourta does not otherwise guarantee particular sporting, organizational, commercial, or other outcomes from using the platform.

13. Account closure and retention

You may request account closure through the available account controls or Contact us. Closure does not automatically cancel outstanding obligations or require deletion of information that must lawfully be retained.

Where necessary and supported by a valid legal basis, relevant records may be retained to meet legal obligations, resolve disputes, or establish, exercise, or defend legal claims. Retention will be limited to the appropriate purpose and period, as explained in our Privacy Policy and required by law.

14. Indonesian law and dispute resolution

These terms and any disputes arising from them or your use of Incourta are governed by the laws of the Republic of Indonesia.

We encourage you to raise concerns through Contact us so that we can attempt to resolve them. Unresolved disputes may be submitted to a competent Indonesian court or other legally authorized dispute resolution body.

Nothing in these terms removes mandatory consumer or data protection rights, or access to a regulator or dispute resolution forum, that applies to you under applicable law.

15. Updates and contact

We may update these terms to reflect changes to the service or legal requirements. We will identify the effective date of updates and provide notice of material changes, obtaining fresh agreement where required. Updates will not retrospectively remove accrued rights.

To report abuse, intellectual property concerns, inaccurate records, privacy issues, or account decisions you wish to challenge, please use Contact us.

If any provision is unenforceable, the remaining provisions continue to apply to the extent legally permitted.
